Du verfügst als Pappkamerad-Besteller über die vollen Rechte an dem von dir hochgeladenen Bild.
(Das Recht am eigenen Bild ist Ausfluss des Persönlichkeitsrechts und als solches in § 22 des KunstUrhG geregelt. Eine Einwilligung des Rechteinhabers zur Veröffentlichung und Verbreitung des Bildnisses wird erforderlich, sobald die abgebildete Person anhand ihrer äußeren Erscheinung identifizierbar ist. Dies ist der Fall, wenn z.B. das Gesicht der Person gezeigt wird.)
Sollte durch die Verwendung eines durch Dritte geschützten Motivs eine Rechtsverletzung vorliegen, wird das FPMG oder die Borussia VfL 1900 Mönchengladbach GmbH (BMG) den Urheber und somit Rechteinhaber im vollen Umfang und mit sämtlichen Forderungen an Dich verweisen.
Wir bitten dich daher Folgendes zur Kenntnis zu nehmen: [1]
1. Aufnahmen vom Pappkameraden bei Spielen unter Ausschluss der Öffentlichkeit (Veranstaltung): Zur öffentlichen Berichterstattung über die Veranstaltung und den Wettbewerb sowie zu deren Promotion können der Club und der nach Ziffer 3 jeweils zuständige Verband oder von ihnen jeweils beauftragte oder sonst autorisierte Dritte (z.B. Rundfunk, Presse) nach Art. 6 Abs. 1 S. 1 f) DSGVO unabhängig voneinander Bild- und Bildtonaufnahmen erstellen, die den Pappkameraden „als Zuschauer“ der betreffenden Veranstaltung zeigen können. Diese Bild- und Bildtonaufnahmen können durch den Club sowie den nach Ziffer 3 zuständigen Verband und den jeweils mit ihnen nach § 15 AktG verbundenen Unternehmen sowie von ihnen jeweils autorisierten Dritten (z.B. Rundfunk, Presse) nach Art. 6 Abs. 1 S. 1 f) DSGVO verarbeitet sowie verwertet und öffentlich wiedergegeben werden.
2. Erwerb von Pappkameraden für weitere Personen: Erwirbt ein Kunde einen Pappkameraden nicht nur für sich selbst, sondern für weitere Personen, muss der Kunde die Weiterleitung der Inhalte dieser Regelung an den betreffenden Dritt-Kunden sicherstellen. Er muss sich die Einverständniserklärung derjenigen Person, für die er einen Pappkameraden erstellen lassen will, einholen.
3. Zuständiger Verband: Für die Organisation der sportlichen Wettbewerbe, an denen der Club teilnimmt, sind die folgenden Verbände zuständig:
  a. Bundesliga und 2. Bundesliga: DFL Deutsche Fußball Liga e.V. mit Sitz in der Guiollettstraße 44-46, D-60325 Frankfurt am Main, dessen operatives Geschäft die DFL Deutsche Fußball Liga GmbH mit Sitz in der Guiollettstraße 44-46, D-60325 Frankfurt am Main führt;
  b. DFB Pokal: DFB Deutscher Fußball-Bund e.V. mit Sitz in der Otto-Fleck-Schneise 6, D-60528 Frankfurt/Main; und
  c. UEFA Champions League und UEFA Europa League: Union of European Football Associations (UEFA) mit Sitz in Route de Genève 46, CH-1260 Nyon (“UEFA”).“

[1] Um die Lesbarkeit dieses Passus zu vereinfachen, wird auf die zusätzliche Formulierung der weiblichen Form verzichtet. Wir möchten deshalb darauf hinweisen, dass die ausschließliche Verwendung der männlichen Form explizit geschlechtsunabhängig verstanden werden soll.

Sollte es dazu kommen, dass die Spiele nicht unter Ausschluss der Öffentlichkeit gespielt werden (sondern der Spielbetrieb wieder normal aufgenommen wird) oder die laufende Saison von den zuständigen Stellen komplett abgesagt und beendet wird, besteht kein Anspruch des Pappkamerad-Bestellers, dass der Pappkamerad im Stadion aufgestellt wird. Ein Anspruch auf Rückerstattung besteht nicht. In einem solchen Fall bekommen die jeweiligen Besteller die Figur direkt ausgehändigt.

As a purchaser of a cut-out, you own full rights to the picture uploaded by you.

(The right to your own picture is a consequence of the right to privacy and is regulated as such in § 22 of the KunstUrhG. The consent of the rights holder to publish and distribute the picture is required as soon as the person depicted can be identified by their outward appearance. This is the case if, for example, the face of the person is shown).

Should you violate rights through the use of an image protected by a third party, the FPMG or Borussia VfL 1900 Mönchengladbach GmbH (BMG) will refer the author and thus the rights holder to you to the full extent, including all claims.

We therefore ask you to take note of the following:

Recordings of the cut-out at matches behind closed doors (event): For the purpose of public reporting on the event and the competition and for its promotion, the Club and the association responsible under subparagraph 3, or third parties commissioned or otherwise authorised by them (e.g. radio, press) can independently produce image and sound recordings which can show the cut-out "as a spectator" of the event in question in accordance with Art. 6 Para. 1 p. 1 (f) of the GDPR. These image and sound recordings may be processed, commercialised and publicly reproduced by the Club and the association responsible in accordance with subparagraph 3 and the companies affiliated with them in accordance with § 15 AktG, as well as by third parties authorised by them (e.g. radio, press) in accordance with Art. 6 Para. 1 sentence 1 (f) of the GDPR.
The purchase of cut-outs for other persons: If a customer purchases a cut-out not only for themselves but also for other persons, the customer must ensure that the contents of these regulations are passed on to the third-party customer concerned. They must obtain a declaration of consent from the person of whom they want to have a cut-out made.
Responsible association: The following associations are responsible for the organisation of the sporting competitions in which the Club participates:
1. Bundesliga and Bundesliga 2: DFL Deutsche Fußball Liga e.V. with its registered office at Guiollettstraße 44-46, D-60325 Frankfurt am Main, whose operative business is conducted by DFL Deutsche Fußball Liga GmbH with its registered office at Guiollettstraße 44-46, D-60325 Frankfurt am Main;
2. DFB-Pokal: DFB Deutscher Fußball-Bund e.V. with its registered office at Otto-Fleck-Schneise 6, D-60528 Frankfurt/Main; and
3. UEFA Champions League and UEFA Europa League: Union of European Football Associations (UEFA), with its registered office at Route de Genève 46, CH-1260 Nyon ('UEFA')

Should it be the case that games are not played behind closed doors (but that the football season is resumed normally) or the current season is completely cancelled and ended by the responsible authorities, the cut-out purchaser is no longer entitled to have their cut-out set up in the stadium. In such a case, the respective purchasers will be able to collect their cut-out personally.
